Terms and Conditions
This Extranet (the "Extranet") is provided by Hannover Re. By entering the Extranet, the user agrees to abide by the following terms and conditions of use. Hannover Re reserves the right to modify or amend these terms and conditions at any time.
General
Hannover Re hosts the Extranet at which investors and other authorized parties can access documents. The Extranet is provided for the benefit of investors and other authorized parties. The Extranet provides investors with secure access to important legal documents and other transaction related documents.
Access
By accessing the Extranet, you agree to comply with the terms set forth herein. You will be granted a User ID for access to the Extranet. You agree that your User ID is only for your personal use, and you will not permit anyone else to use your User ID. You are responsible for all access to the Extranet through your User ID. If you believe that another party has gained access to your User ID, you must inform Hannover Re immediately. You may not transfer your User ID to anyone else.
Hannover Re reserves the right to suspend user privileges and block access of any user who violates these Terms and Conditions.
Permitted Uses
- General
Your User ID only allows you to view materials related to your relationship with Hannover Re, and provides no ability to view materials for any other party. You shall not attempt to access or view materials for any other party. If for any reason you obtain access to any materials not related to your relationship with Hannover Re, you shall immediately inform Hannover at extranet-gp@hannover-re.com and refrain from viewing or downloading such materials.
- Viewing and Downloading
You have the ability to view and download materials including documents and other transaction related documents. You must maintain the appropriate level of confidentiality for material that you download from Hannover Re Extranet and keep the material confidential, according to the terms and conditions of the confidentiality agreement. Hannover Re is not responsible for the security of any material that you download from the Hannover Re Extranet.
Security
The Hannover Re Extranet uses industry standard security protection to protect against unauthorized access, including firewall protection. Hannover Re may change or enhance the security protection without notice to you. You shall not attempt to disable or circumvent any security features on the Hannover Re Extranet.
Termination
You may terminate your access privilege to the Hannover Re Extranet at any time by providing written or email notice to Hannover Re at extranet-gp@hannover-re.com Hannover Re also reserves the right to terminate your registration and/or access to the Hannover Re Extranet at any time without notice.
Disclaimer of Warranties
Access to the Hannover Re Extranet and its content, products and services are provided "as is." Hannover Re does not make any warranties or representations, expressed or implied, concerning the merchantability, quality, non infringement or fitness for a particular purpose of the Hannover Re Extranet or its content. You assume all risk of use. No warranty is given that the services will be error-free, free of viruses or uninterrupted. Hannover Re is not responsible for invalid destinations and transmission errors in, corruption of, or the security of information carried over telecommunications carriers' or other providers' facilities. Hannover Re has no liability for faulty or interrupted communication links. You acknowledge that portions of the content of the Hannover Re Extranet are provided by third party users, and Hannover Re has no control over, or liability for any such content.
Note: This disclaimer does not apply to the reports as set out in the respective Article of the various Reinsurance Agreements. With regard to the reports, the agreed terms as set out in the respective Reinsure Agreements shall prevail.
Limitation of Liability
Hannover Re shall not be liable to you or any third party for any direct, special, indirect, consequential or incidental damages incurred arising out of the use or the inability to use the Hannover Re Extranet, even if Hannover Re has been advised of the possibility of such damage or loss.
Ownership
The Hannover Re Extranet is owned by Hannover Rückversicherung AG. Elements of the site are also protected by trademark, copyright and other laws.
Choice of Law / jurisdiction
These terms and conditions shall be construed according to German law, however, the Conflict of Law rules shall not apply. If the English legal meaning differs from the German legal meaning of this terms and conditions, the German legal meaning shall prevail.
In the event that any legal proceedings are commenced in any court with respect to any matter arising under this terms and conditions, the parties hereto specifically consent and agree that the courts of Hannover shall have jurisdiction over each of the parties hereto and over the subject matter of any such proceedings, and the venue of any such action shall be the regional court in Hannover.
